1. Who We Are
These Terms & Conditions ("Terms") are an agreement between you and Srishti Dance Academy ("Srishti," "the Academy," "we," "us," or "our").

2. Acceptance of These Terms
These Terms apply when you visit the Website, buy a class plan, register a student, or take part in any class, rehearsal, workshop, performance, or event run by the Academy (together, the "Services"). By doing any of these things, you agree to these Terms, our Studio Policies, our Liability Waiver and Media Release, and our Privacy Policy.
If you are registering a student under 18, you confirm that you are that student's parent or legal guardian and that you accept these Terms for yourself and for the student. A "Parent/Guardian" means the adult who signs the Registration Form or buys a plan for a minor.
If you do not agree, please do not use the Website or the Services.
3. Eligibility

Adults (18 and older) may register themselves.

A Parent/Guardian must register any student under 18 and must accept these Terms for them.

The "Mommy n Me" program requires a participating Parent/Guardian to be present with the child for the entire class.

We may decline or cancel a registration at our reasonable discretion, for example because a class is full, the student does not fit the class level, or a required form was not signed.
4. Classes and Programs

We offer classes in classical and contemporary Indian dance forms, which currently include Kuchipudi, Bharatanatyam, semi-classical (Kathak-based), Bhangra, and Bollywood, for kids, adults, and parent-child ("Mommy n Me") groups.

Classes are taught in groups based on each student's age and skill level. The Academy decides which group a student joins and may move a student to a different group.

A standard monthly plan includes four (4) classes per month (one class per week) unless the plan description says otherwise.

We recommend regular attendance and practice at home at least twice a week.

Students are responsible for material covered in classes they miss and are expected to catch up.

We may change class schedules, instructors, locations, or curriculum. When we can, we will give reasonable advance notice by email, text message, or a post on the Website.
5. Fees, Payments, and Deposit

5.1 Tuition. Current tuition is shown on the Website or in the Registration Form. If the two differ, the amount confirmed to you in writing at registration applies. We may change tuition with at least thirty (30) days' notice before your next billing cycle.

5.2 Due date. Monthly tuition is due in advance on the first class of each month.

5.3 Late fee. If tuition is not paid by the end of the first week of the month, a late fee of $10.00 will be added.

5.4 Registration deposit. When you register, we require a deposit equal to one (1) month of tuition. We hold the deposit and apply it as described in Section 6.

5.5 Joining mid-month. New students who join partway through a month pay only for the classes left in that month.

5.6 Extra and performance classes. Extra rehearsals or classes needed for a specific performance are priced separately. We will tell you the price before you commit.

5.7 Online payments. Payments made through the Website are processed by our third-party payment providers (for example, Wix Payments, Stripe, or PayPal). We do not see or store your full card number. When you pay online, you authorize us and our payment provider to charge your selected payment method for the amounts shown. If you choose a recurring monthly plan, you authorize a charge every billing cycle until you cancel as described in Section 6.

5.8 Failed payments. If a payment fails or is reversed, we may suspend attendance until the account is paid up, including any late fee.
6. Discontinuing, Pausing, and Refunds

6.1 Notice to stop or pause. If a student is leaving the Academy or taking a break, please give us written notice (email is fine) at least one (1) month before the start of the next billing cycle. With proper notice, we will apply your registration deposit to that final month's tuition.

6.2 Without proper notice. If you do not give one month's notice, the deposit is kept in place of that notice and is not refunded.

6.3 Missed classes. We do not give refunds or credits for classes a student misses. This includes absences for illness, travel, or personal reasons.

6.4 Cancelling a recurring online plan. You can cancel a recurring plan from your Website account (where available) or by emailing us. Cancellation stops future charges. Section 6.1 still applies.

6.5 Academy-cancelled classes. If the Academy cancels a class for reasons other than a scheduled holiday or closure (Section 7), we will try to reschedule it. If we cannot reschedule, we will give you a credit toward future tuition.

6.6 Your legal rights. Nothing in this section limits any refund rights you have under applicable law.
7. Holidays, Closures, and Makeup Classes

The studio is closed on national holidays and on all major long weekends.

In months with holidays, we try to provide extra makeup classes or to include makeup time in the extra practices before the annual recital. We do not guarantee makeup classes.

A performance / show day counts as a class, so the next regular class after a show day is cancelled for all students.

We may also close the studio for severe weather, emergencies, instructor illness, or other events outside our control. See Section 17.
8. Performances

Performances are optional. Students are encouraged to perform at events but do not have to.

Instructors select which groups and students perform, based on readiness, attendance, and other artistic factors. Those decisions are final.

When students perform for the Academy, they represent the Academy and must follow its performance rules, including rules on costumes, conduct, call times, and rehearsals.

Parents/Guardians must go with minor students to performance venues and are responsible for them there, except when the student is on stage or in a supervised backstage area.

Outside performances. Students may perform at events that do not involve the Academy with the Academy's prior permission, particularly where Academy choreography is used or the Academy's name is mentioned.

Costumes, props, event tickets, and venue fees may cost extra. We will tell you about these costs ahead of time.
9. Code of Conduct and Studio Rules
All students, parents, guardians, and visitors agree to follow the Studio Policies. In short:

Treat everyone with respect, respect their personal space, and be polite at all times.

Instructors may discipline a student or send them out of class for misconduct. We may suspend or end enrollment, without a refund, for serious or repeated misconduct, harassment, abusive language, unsafe behavior, or damage to property.

Parents are not allowed in the dance area during class.

Harassment, bullying, and discrimination of any kind are not tolerated.
10. Safety, Supervision, and Pickup

Do not leave younger children unattended in the studio or waiting area before or after class.

All students must be picked up within 10 minutes after class ends. Please be on time.

The Academy supervises minors only during their scheduled class time and while they are in the dance area. Outside those times, the Parent/Guardian is responsible for the minor, including in the waiting area, parking lot, and common areas of the building.

[OPTIONAL: Repeated late pickups (more than 10 minutes) may result in a late-pickup fee of $[__] per [__] minutes.]

Please tell us in writing about any medical condition, allergy, injury, or physical limitation that may affect a student's participation. Students should not take part if a doctor has advised against it.

Emergency medical care: If a student needs urgent care and we cannot reach the Parent/Guardian, you authorize the Academy to call emergency services and to arrange emergency treatment. You are responsible for the costs of that treatment.
11. Studio Property and Personal Belongings

Respect the studio and its property. Do not let children or siblings play with studio equipment or property.

Do not touch the mirrors with hands or bodies.

Pick up your trash and belongings. Do not switch, adjust, or operate lights, sound systems, thermostats, or other equipment without permission.

You are responsible for paying for damage that you, your student, or your guests cause to studio property on purpose or through carelessness.

Do not bring valuables into the studio or waiting area. The Academy is not responsible for lost, stolen, or misplaced property. Items left behind for more than 30 days may be donated or thrown away.
12. Recording and Photography by Families
To protect the privacy of all students and the Academy's choreography, do not record video or take photos of classes without an instructor's permission. At recitals and performances, you may record your own child for personal, non-commercial use only. Do not post recordings that show other students without their families' consent.
13. Intellectual Property

13.1 Academy content. The Website and its content are owned by or licensed to the Academy and protected by copyright and trademark law. This includes the name "Srishti Dance Academy," logos, text, graphics, photos, videos, choreography, music arrangements, curriculum, and class materials. You may view the Website and use class materials for your own personal, non-commercial learning. You may not copy, sell, teach commercially, or publicly perform Academy choreography or materials without our written permission.

13.2 Your content. If you send us content (for example, reviews, testimonials, or photos), you give us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with the Academy. You confirm that you have the right to grant this license.
14. Use of the Website
When using the Website, you agree not to:

give false information or register someone without authority;

break any law or anyone else's rights;
-
try to gain unauthorized access to the Website, its systems, or other users' accounts;

upload malware or interfere with how the Website works;
-
scrape, harvest, or collect other users' information.
The Website runs on a third-party platform (Wix.com) and may link to third-party sites, such as social media and payment processors. We are not responsible for third-party sites or services. Your use of them is governed by their own terms.
15. Disclaimers
The Services and Website are provided "as is" and "as available." As far as the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any particular skill level, performance selection, or result, and we do not guarantee that the Website will be uninterrupted or error-free.
Dance is a physical activity. Talk to a doctor before starting if you have any health concerns.
16. Limitation of Liability
As far as the law allows, the Academy and its owners, officers, instructors, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages arising from the Services or the Website. The Academy's total liability for any claim relating to the Services or the Website is limited to the tuition you paid in the three (3) months before the claim arose.
This section does not limit liability that cannot be limited under Florida law, such as liability for gross negligence or intentional misconduct. Personal-injury matters are covered by Part C.
17. Events Outside Our Control
We are not responsible for delays or failure to provide the Services caused by events outside our reasonable control. These include hurricanes and severe weather, natural disasters, public-health emergencies, government orders, power or internet outages, and facility closures. When possible, we will offer rescheduled classes, virtual classes, or a tuition credit.
18. Indemnification
You agree to defend, indemnify, and hold harmless the Academy and its owners, officers, instructors, employees, and agents from claims, losses, and expenses (including reasonable attorneys' fees) that arise from any of the following:

your breach of these Terms;

your misuse of the Website;
-
property damage caused by you, your student, or your guests;

your violation of any law or third-party right.
19. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Before filing a claim, please contact us so we can try to resolve the issue informally within 30 days. Any lawsuit must be brought in the state or federal courts located in Hillsborough County, Florida, and you consent to their jurisdiction. Small-claims matters may be brought in the small-claims court for that county.
20. Changes to These Terms
We may update these Terms. When we do, we will post the new version on the Website with a new "Last Updated" date. For material changes, we will notify enrolled families by email. If you keep using the Services after the effective date, you accept the updated Terms.
21. General

These Terms, the Studio Policies, the signed Registration Form and Waiver, and the Privacy Policy are the entire agreement between us.

If any provision is found unenforceable, the rest remains in effect, and the unenforceable provision will be enforced to the fullest extent allowed.

If we do not enforce a provision, we have not waived it.

You may not transfer your enrollment or these Terms without our consent.
