Liability Waiver, Assumption of Risk, and Media Release

C-1. Assumption of Risk (all participants)

Dance involves physical activity, including jumping, turning, stretching, floor work, footwork (including barefoot dancing and ankle bells/ghungroo), partner and group movement, and performing on stages and at venues the Academy does not control. These activities carry inherent risks. The risks include, but are not limited to:

• sprains, strains, and muscle, joint, or ligament injuries;

• fractures, bruises, cuts, and blisters;

• slips, trips, and falls;

• collisions with other dancers or objects;

• over-exertion, heat-related illness, and dehydration;

• in rare cases, serious injury or death.

Injury may also result from the careless or intentional acts of the participant or other participants.

I understand these risks and knowingly and voluntarily assume them, wherever the activities take place (the studio, rehearsals, performance venues, or events).

C-2. Release for Adult Participants (18+)

In return for being allowed to take part in activities of Srishti Dance Academy, I, for myself and for my heirs, assigns, and next of kin, release, waive, discharge, and hold harmless Srishti Dance Academy and its owners, officers, instructors, employees, volunteers, and agents (the "Released Parties") from any and all claims for personal injury, including death, or property damage arising from my participation, INCLUDING CLAIMS ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES, to the fullest extent allowed by Florida law. This release does not cover gross negligence or intentional misconduct.

C-3. Parent/Guardian Waiver for Minor Participants (under 18)

In accordance with Florida Statute §744.301(3), I, the natural guardian of the minor named below, waive and release, in advance, on behalf of the minor and myself, any claim or cause of action against the Released Parties for personal injury, including death, and property damage that results from the inherent risks of dance activities. This includes the risk that the minor or another participant may act negligently or intentionally and contribute to the minor's injury or death.

 

NOTICE TO THE MINOR CHILD'S NATURAL GUARDIAN

 

READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF SRISHTI DANCE ACADEMY USES REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD'S RIGHT AND YOUR RIGHT TO RECOVER FROM SRISHTI DANCE ACADEMY IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND SRISHTI DANCE ACADEMY HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.

C-4. Medical Authorization

I confirm that the participant is physically able to take part in dance activities. I have told the Academy in writing about any relevant medical conditions. In an emergency, if I cannot be reached, I authorize the Academy to get emergency medical treatment for the participant, and I accept responsibility for the costs.

C-5. Photo and Video Release (opt-out available)

I grant Srishti Dance Academy permission to photograph and record the participant during classes, rehearsals, and performances. I also allow the Academy to use those images, videos, and the participant's first name only on its Website, social media, printed materials, advertising, and promotions, without payment. The Academy will not publish a minor's last name, school, home address, or contact details.

C-6. Acknowledgment and Signature

I have read and agree to the Terms & Conditions, Studio Policies, Privacy Policy, and this Waiver. I am 18 or older and legally able to sign. If the participant is a minor, I am the participant's parent or legal guardian.
